4. No Guarantee of Project Approval

Tricor Design Group may assist clients with permit-ready drawings, development permit support, building permit documentation, planning applications, tenant improvement drawings, residential design packages, commercial drafting, and SDAB appeal representation.

However, Tricor Design Group does not guarantee approval by the City of Calgary, any municipality, permitting authority, planning department, inspection office, appeal board, landlord, property manager, condo board, engineer, consultant, or other third party.

Final approval decisions may depend on zoning bylaws, land use regulations, building code requirements, municipal comments, site conditions, engineering review, planning policies, neighbour concerns, committee decisions, appeal outcomes, and other factors outside our control.

5. Project Inquiries and Consultations

When you submit a project inquiry through our website, email, phone, or another communication channel, you agree to provide accurate and complete information to the best of your knowledge.

This may include your name, contact information, property address, project type, design goals, existing drawings, surveys, site photos, development requirements, permit comments, renovation details, business use requirements, landlord requirements, or other project-related information.

Any initial discussion, consultation, estimate, or general response from Tricor Design Group does not create a formal client relationship unless confirmed through a written proposal, service agreement, signed authorization, deposit payment, or other approved project engagement process.

6. Proposals, Estimates, and Fees

Any estimate, quote, proposal, or fee range provided by Tricor Design Group is based on the information available at the time it is prepared. Project fees may vary depending on the scope of work, size of the project, complexity, required revisions, permit comments, consultant coordination, municipal requirements, urgency, site conditions, missing information, or changes requested by the client.

Unless otherwise stated in writing, estimates and proposals may not include third-party fees, municipal fees, permit fees, engineering fees, survey fees, printing costs, courier fees, inspection fees, consultant fees, appeal filing fees, or other external project costs.

A project may require a signed agreement, written approval, deposit, milestone payment, or full payment before work begins, continues, or is released.

7. Client Responsibilities

To help Tricor Design Group deliver efficient design and drafting services, clients are responsible for providing accurate, complete, and timely information related to their project.

This may include legal property information, surveys, real property reports, existing drawings, site measurements, photos, development requirements, landlord criteria, condo board requirements, business operation details, municipal correspondence, engineering reports, title information, easements, restrictive covenants, and other relevant documents.

Clients are responsible for reviewing drawings, plans, layouts, documents, and project information before submission, construction, or use. Tricor Design Group is not responsible for delays, errors, redesign costs, permit issues, construction complications, or additional fees resulting from incomplete, inaccurate, outdated, or withheld information provided by the client or third parties.

8. Design, Drafting, and Permit Documentation

Tricor Design Group prepares drawings and documentation based on the agreed project scope. This may include concept design, floor plans, elevations, site plans, sections, details, permit-ready drawings, tenant improvement layouts, interior design drawings, residential drafting packages, commercial drafting support, or planning-related documentation.

Permit-ready drawings are prepared to support submission and review; however, additional revisions may be required by municipal authorities, engineers, landlords, consultants, inspectors, or other reviewing parties. Unless included in the project scope, additional revisions, resubmissions, coordination, redesign, or response work may be billed separately.

Drawings and design documents should not be used for construction unless they are issued for that purpose and all required professional reviews, permits, approvals, site confirmations, and consultant requirements have been completed.

9. Revisions and Scope Changes

Tricor Design Group understands that design evolves. Reasonable revisions may be included when clearly stated in a project proposal or agreement.

Additional fees may apply when the client requests changes beyond the agreed scope, including major layout changes, new design directions, additional units, added floors, expanded building area, repeated revisions, change of use, new permit requirements, redesign due to municipal comments, consultant-driven revisions, landlord changes, construction changes, or updated client preferences after approval of previous work.

Scope changes must be confirmed in writing before additional work proceeds.

10. Third-Party Consultants and Authorities

Some projects may require involvement from third-party professionals or authorities, including engineers, surveyors, architects, contractors, builders, energy advisors, code consultants, planning consultants, municipal reviewers, inspectors, landlords, property managers, condo boards, legal professionals, or SDAB-related parties.

Tricor Design Group may coordinate with third parties as part of the project scope, but we are not responsible for their actions, delays, fees, decisions, errors, omissions, professional opinions, approval timelines, or final determinations.

11. Timelines and Delivery

Tricor Design Group works to complete projects within reasonable timelines based on the agreed scope and available information. Any estimated timeline is provided as a general expectation, not a guaranteed completion date.

Project timelines may be affected by client response times, missing documents, design revisions, permit comments, municipal processing times, consultant coordination, third-party delays, seasonal workload, project complexity, payment delays, site access, or changes in scope.

Tricor Design Group is not liable for delays caused by factors outside our reasonable control.

12. Payments and Outstanding Balances

Payment terms will be outlined in the applicable proposal, invoice, service agreement, or written communication. Clients agree to pay all approved fees, deposits, invoices, and additional charges according to the stated payment terms.

Tricor Design Group may pause work, delay submissions, withhold files, suspend services, or decline further revisions if payments are overdue or if required deposits have not been received.

Unless otherwise agreed in writing, completed drawings, design files, permit documents, and project deliverables may not be released until applicable outstanding balances are paid.

13. Cancellations and Refunds

If a client wishes to cancel a project after work has started, the client may be responsible for payment for all work completed, time spent, coordination performed, documents prepared, consultations provided, and expenses incurred up to the date of cancellation.

Deposits, retainers, and milestone payments may be non-refundable depending on the work completed and the terms of the project agreement. Refund eligibility, if any, will be reviewed based on the project scope, completed services, and written agreement between the client and Tricor Design Group.

14. Intellectual Property

All website content, written content, service descriptions, logos, graphics, layouts, images, design concepts, drawings, plans, documents, and other materials created by or for Tricor Design Group are protected by applicable intellectual property rights.

Unless otherwise agreed in writing, Tricor Design Group retains ownership of original design concepts, drafting files, editable source files, templates, internal systems, presentation materials, and related intellectual property.

Upon full payment, clients may receive the right to use final issued project documents for the specific property and project for which they were prepared. Drawings, plans, designs, or documents may not be copied, reused, modified, sold, transferred, or used for another property or project without written permission from Tricor Design Group.

15. Use of Project Images and Portfolio Materials

Tricor Design Group may request permission to use selected project images, renderings, drawings, completed project photos, or general project descriptions for portfolio, website, marketing, social media, SEO content, case studies, or promotional purposes.

Private client information, sensitive documents, full addresses, and confidential materials will not be intentionally published without appropriate permission, unless the information is already public or legally required. Clients may notify Tricor Design Group in writing if they do not want their project featured in marketing materials.

16. Accuracy of Measurements and Site Conditions

Design and drafting work may rely on measurements, surveys, existing plans, real property reports, photos, site information, or documents provided by the client or third parties.

Tricor Design Group is not responsible for inaccurate existing conditions, hidden site issues, unverified dimensions, undocumented structural elements, utility conflicts, grading conditions, easements, encroachments, restrictive covenants, or discrepancies discovered after design work has begun.

Site verification, engineering review, contractor review, and professional confirmation may be required before construction, permit submission, or final implementation.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Tricor Design Group shall not be liable for indirect, incidental, consequential, special, punitive, or financial damages arising from website use, project delays, permit outcomes, construction decisions, third-party actions, lost opportunities, business interruption, or reliance on general website content.

Our responsibility for any project is limited to the specific services agreed in writing. Tricor Design Group is not responsible for construction means and methods, contractor workmanship, unauthorized changes, site safety, material selection, engineering decisions outside our scope, or work performed by others.

18. No Professional Engineering or Legal Advice Unless Stated

Tricor Design Group provides design, drafting, planning support, and related documentation services. Unless specifically stated in writing, our services do not replace the work of licensed engineers, legal counsel, land surveyors, code consultants, architects, or other regulated professionals when such services are required.

For legal matters, real estate title issues, restrictive covenants, easements, contractual disputes, liability concerns, or legal interpretation of SDAB appeal matters, clients should consult a qualified legal professional.

For structural, mechanical, electrical, civil, geotechnical, energy, fire, life safety, or code-specific engineering requirements, clients may need review by the appropriate licensed professional.
